Ongoing Cases

Langerhans v. Kia America, Inc., Case No. 26-1441

United States Fourth Circuit Court of Appeals

Migliaccio & Rathod LLP has brought forward a case against Kia America, Inc. for an alleged defect found in 2022-2023 Kia Carnival vehicles in which the minivan’s sliding doors close with excessive force, creating a risk for bodily injury. Consumers report that at times the doors do not stop and can injure a person between the edge of the door and vehicle body. Litigation is currently ongoing.

Beecher et al v. Volkswagen Group of America, Inc., Case No. 1:25-cv-9555

United States District Court for District of New Jersey

Migliaccio & Rathod LLP has brought a case forward against Volkswagen Group of America, Inc. for an alleged defect found in 2021-2023 Volkswagen ID.4 vehicles in which the vehicle’s overly sensitive haptic touch controls on the steering wheel engages Adaptive Cruise Control, resulting in sudden, unintended acceleration. This creates possibly fatal danger for the driver and others on the road. Litigation is currently ongoing.

Crowell et al. v. FCA U.S., LLC, Case No. 1:23-cv-00013-MN

United States District Court for the District of Delaware

Migliaccio & Rathod LLP’s auto defect lawyers, alongside co-counsel, have brought a case against FCA U.S., LLC for an alleged defect found in the 2021-2023 model year Jeep Wrangler 4xe and the 2022-2023 Jeep Grand Cherokee 4xe. Consumers have reported a defect in which the vehicles are locked into the Fuel and Oil Refresh Mode (FORM) for extended periods of time, making electronic-only or electric assisted driving impossible. Litigation is currently ongoing.

Senevirante v. Ford Motor Company, Case No. TBD

United States District Court for the District of Maryland

Migliaccio & Rathod LLP is working to bring forward a case against Ford Motor Company for an alleged defect found in 2021-2026 Ford Bronco vehicles in which a key feature of the car, the removeable rooftop, is subject to delamination, discoloration, and cracking. This can leave the car vulnerable to further damage. Litigation will soon be filed on this matter.

In re: Chevrolet Bolt EV Battery Litigation, Case No. 2:20-cv-13256-TGB-CI

United States District Court for the Eastern District of Michigan

Migliaccio & Rathod is serving on this consolidated class action suit’s Steering Committee to move forward claims against various Defendants for alleged manufacture and sale of defective high voltage batteries used in the 2017- 2022 Chevrolet Bolt vehicles. General Motors issued recalls related to this defect that, they reported, poses a severe fire risk to any Bolt vehicle at or near full charge, even when the vehicle is parked, turned off, and not receiving an external charge. In response to this defect, General Motors’ solution was to implement a software update that substantially reduces the Bolt’s battery capacity and limits the vehicle’s driving range. Bolt owners are left with a diminished vehicle that, had they been made substantially aware of the defect, they either would not have purchased or would only have purchased at a much lower price.
