Current Cases
Medley, et al. v. District of Columbia; Office of the Attorney General for the District of Columbia; and Latino Economic Development Corporation of Washington, D.C., Case No. 2024-CAB-006478 (D.C. Super. Ct.). Migliaccio & Rathod LLP has filed a class action lawsuit against the District of Columbia for mismanaging the D.C. Homeowner Assistance Fund (HAF). Plaintiffs allege that, after approving applications and assuring struggling homeowners that their mortgage arrearages would be covered, the District abruptly reversed course when funds ran out, leaving approved applicants without relief. The complaint charges the defendants with violating due process, engaging in unfair and deceptive practices, and making false promises that caused homeowners to forgo alternatives while facing foreclosure. The case seeks damages, restitution, and injunctive relief to hold the District accountable.
Richards, et al. v. District of Columbia Water & Sewer Authority, Case No. 2024-CAB-007383 (D.C. Super. Ct.). Migliaccio & Rathod LLP has filed a class action lawsuit against the District of Columbia Water and Sewer Authority (DC Water/WASA) challenging its late fee policies. The complaint alleges that WASA imposes unlawful liquidated damages through a 10% “Customer Penalty Late Fee” after 30 days and a compounding 1% monthly “Additional Penalty Late Fee” after 60 days, which bear no reasonable relationship to actual damages from late payment. Plaintiffs contend these penalties trap consumers—who have no choice but to use DC Water—in cycles of recurring charges, violating the D.C. Consumer Protection Procedures Act and common law. The suit seeks damages, restitution, and an injunction to stop WASA’s unlawful late fee practices.
Valsartan N-Nitrosodimethylamine (NDMA) Products Liability Litigation, MDL Case No: 1:19-md-02875-RBK-JS (D.N.J.). Represented plaintiffs in multi-district litigation arising from worldwide recalls of generic Valsartan that had been found to be contaminated with probable human carcinogens. M&R was appointed to the Plaintiffs’ Steering Committee and serves as co-chair of the medical monitoring committee. The court granted class certification for medical monitoring for several states and appointed M&R attorney as one of two class counsel.
Calorie Content of BCAA, Glutamine, and Citrulline Products: Migliaccio & Rathod LLP is currently investigating and has filed multiple cases against companies who allegedly utilize deceptive marketing claims regarding the Calorie content of Branched-Chain Amino Acids (BCAA), Glutamine, and Citrulline-based supplemental powders. Many of these products across the market prominently display on the product’s label a representation of 0-5 calories per serving or omit the Caloric nutritional fact completely from packaging. This poses a major issue for customers who purchase nutritional supplements as part of their broader health and fitness goals and are depending upon accurate information from the manufacturers’ representations of Calorie content.
