Nurses Not Paid for On-Call Work by CHI, Federal Lawsuit Alleges

On February 14, 2023, Judge Brian C. Buescher of the United States District Court for the District of Nebraska granted final approval on a settlement which provides compensation for medical nurses working remotely while on an on-call shift, from February 6, 2015 through April 11, 2022 at various CHI facilities throughout the state. The settlement fund is just shy of a million dollars, allocated to nurses who timely submitted valid claim forms and distributed proportionally based on amount owed to each individual, with a minimum of $15 per person.

Nurses at various hospitals in Iowa and Nebraska that are run by CHI have alleged in a federal collective action lawsuit that they were not properly paid for time spent performing work remotely, such as by phone and text messaging, while they were on-call. The lawsuit was filed in February 2018. Since then, the Honorable Brian C. Buescher who is presiding over the case has rejected an early motion by CHI to have the case dismissed. He also ordered that the case could proceed on a collective basis, allowing other nurses throughout the hospital system the opportunity to join the lawsuit if they would like to do so.
