Investigations

Livestock Air Pollution
Migliaccio & Rathod LLP’s environmental lawyers in DC are investigating the loss of enjoyment of property, and possible health hazards, experienced by residents who live by livestock feedlots. For example, Minnesota residents in Goodhue County allege that the neighboring feedlot is violating environmental law on air quality standards with excessive odorous fumes. The Minnesota Pollution Control Agency (MPCA), a regulatory body that manages feedlots and monitors air quality, has not tested for fumes like hydrogen sulfide since 2009, though its short-term monitoring found hydrogen sulfide levels that could exceed the health risk limit.

Ethylene Oxide Emissions
Migliaccio & Rathod LLP’s environmental lawyers in DC are currently investigating chemical plants across the United States that emit ethylene oxide into the air, despite the environmental law on known public health risks of doing so. Ethylene oxide is commonly used as a sterilizing agent for medical equipment, and as an intermediate in chemical manufacturing. Although long considered hazardous, the Environmental Protection Agency (EPA) concluded in late 2016 that ethylene oxide was in fact 30 times more carcinogenic than previously thought. For decades, then, countless Americans living and working near chemical plants that handle ethylene oxide have, without their knowledge or consent, been exposed to a potent cancer-causing agent. Meanwhile, EPA regulatory standards remain based upon research conducted in the 1980s, leaving vulnerable communities exposed to this toxic gas.

Oil Refinery Emissions
Migliaccio & Rathod LLP’s environmental lawyers in DC are currently investigating oil refineries across the country for their well-documented emissions including noxious odors, noise, debris particles, and fumes. Despite the environmental laws and known public health risks of doing so, many refineries who manufacture gasoline, propane, asphalt, and refinery-grade propylene, and more continue to operate in close proximity of whole communities who are subject to the biproducts and nuisances which are detrimental to their physical and financial well-being.

Water Pollution
Migliaccio & Rathod LLP’s environmental lawyers in DC are cognizant of and fighting against various instances of water pollution which emerge from plentiful manufacturing sources and can create widespread detrimental impacts on human health and property values. Biproducts, like PFAS and Coal Ash, of certain energy producers, corporate farms, and more are regularly found to be polluting water sources. Be it through ground water and runoff contamination, direct flowing channels, or other naturally occurring or manufactured movement of chemicals, the producers of such chemicals who fail to contain and treat the hazardous waste ought to be held accountable for the far reaching impacts that inevitably follow. Communities deserve access to safe water sources and certainly should be made known when they are exposed to the contrary.
