Migliaccio & Rathod LLP is investigating potential contamination of farmland, soil, and groundwater in eastern Arapahoe County, Colorado. This issue is linked to the use and sale of biosolids containing per- and polyfluoroalkyl substances (PFAS). Various reports indicate that Denver’s wastewater system has applied sewage sludge containing PFAS to farmland and distributed these biosolids to neighboring farms to use as fertilizer. PFAS, also known as “forever chemicals,” do not break down and can accumulate in soil, water, agriculture, and the human body over time.
Reported Issues:
Consumers report:
- That biosolids applied to farmland may contain PFAS
- That they were unaware that fertilizer products derived from sewage sludge could introduce toxic chemicals into soil and water
- That PFAS contamination may have impacted the quality of soil, livestock, crops, or water
- That no adequate warnings were given regarding the risks associated with biosolid application
- That they are concerned about the health consequences associated with PFAS exposure such as high cholesterol, compromised immunity, liver damage, and an increased risk of cancer and infertility
- That they would not have used or accepted biosolids on their land if they knew about the risk of contamination
- That Metro Water Recovery, Denver’s wastewater system, may have known about the risks of PFAS in their biosolids since at least 2010
Why Individuals Should Be Concerned:
Potential claims include:
