Migliaccio & Rathod LLP is investigating potential lead contamination in playgrounds throughout New Orleans following research showing that approximately half of the city’s playgrounds have lead concentrations exceeding federal hazard levels. Exposure to lead can cause serious and irreversible health effects for children, including developmental delays, learning difficulties, and neurological harm. Some of the playgrounds identified in public reports for having elevated lead levels include Mickey Markey Park, Evans Park, and Brignac Playground.
Reported Issues:
Consumers report:
- That they were unaware that playground soils may contain lead
- That there were no warning signs or public notices displayed at potentially contaminated playgrounds
- That the city failed to adequately monitor, test, or maintain safe conditions at public playgrounds
- That children were allowed to play on playgrounds with elevated levels of lead, putting them at risk for lead contamination and serious medical conditions
- That they are concerned about potential health impacts from past exposure to lead
- That their kids have had to undergo medical testing for lead exposure
Why Individuals Should Be Concerned:
Potential claims include:
- Exposure to toxins
- Safety concerns
- Failure to maintain safe public recreational spaces
- Failure to disclose known or reasonably knowable hazards
- Negligence
