Migliaccio & Rathod LLP is currently investigating potential deceptive marketing claims concerning mislabeled melatonin and CBD gummies sold as sleep aids. Recent independent testing hit the news for its findings that many gummies of this sort contain dangerously high levels of melatonin, a naturally occurring hormone that contributes to sleep regulation. Additionally, some sleep aid gummies labeled as melatonin gummies contained no melatonin at all and instead contained cannabidiol (“CBD”). Other sleep aid gummies were sold containing both melatonin and CBD in violation of federal regulations from the US Food and Drug Administration controlling how CBD is marketed.
Both consumers and researchers have expressed concern about these findings of elevated levels of melatonin and/or CBD, especially because gummy sleep aids are often given to or mistakenly consumed by children. Overuse of melatonin or CBD can cause negative health outcomes in children’s sleep schedules, their hormonal development, and other side effects. These unfortunate outcomes are evidenced by a rise over the past four years of poison control calls to the US Centers of Disease Control and Prevention relating to melatonin ingestion by children. Regardless of age, consumers depend upon accurate labeling in health-related products. Without accurate dosing and labeling, the products cannot meet reasonably expected standards for health-related products.
