Migliaccio & Rathod LLP is investigating whether HearUSA has improperly denied refunds or imposed excessive charges on consumers who attempted to return hearing aids.
HearUSA is a national hearing-care provider operating hundreds of centers, including offices in New York City, Long Island, and other parts of the state.
Consumers are not always limited to the retailer’s return period. In New York, for example, hearing-aid purchasers generally have 45 days to return a device, subject to specific legal requirements. The law also limits the amount a seller can retain from a canceled purchase and provides additional time when a dispenser takes possession of the device after delivery.
Migliaccio & Rathod is investigating whether HearUSA customers have had trouble exercising these rights, including being refused returns, charged excessive cancellation fees, or told their return period expired while their hearing aids were being serviced.
Consumers May Have Experienced:
- Confusion about hearing-aid purchase terms, return periods, refund eligibility, or warranty coverage;
- Sales disclosures that customers believe did not adequately explain their rights or obligations;
- Disputes over hearing-aid performance, fitting, repairs, or follow-up services;
- Difficulty obtaining a refund or resolving a complaint concerning a hearing-aid purchase.
Potential Claims May Include:
- Violations of applicable state hearing-aid disclosure or return requirements;
- Unfair or deceptive business practices;
- Misrepresentation or omission of material purchase terms;
- Breach of contract or warranty, where applicable;
- Improper billing or financing practices, if supported by the evidence.
Signs You May Be Affected:
- You purchased hearing aids from HearUSA and believe required sales disclosures were missing or incomplete;
- You were not clearly informed about applicable return or refund rights;
- You tried to return a product or obtain a refund and were denied or charged unexpected fees;
- You have purchase records, signed disclosures, financing documents, or written communications about the dispute.
