Paradise Grills sells premium outdoor kitchens that can cost thousands or even tens of thousands of dollars. Consumers purchasing a built-in outdoor kitchen may reasonably expect that the appliances supplied with it are appropriate for installation and use outdoors.
Some customers, however, have reported discovering after purchase that the refrigerator included with their Paradise Grills kitchen was a standard indoor or bar refrigerator rather than an outdoor-rated appliance. One reported customer was told by the refrigerator manufacturer that the supplied Haier model was not made for outdoor use.
Consumers Report:
- purchasing an expensive Paradise Grills outdoor-kitchen package;
- receiving a compact or bar refrigerator as part of the installation;
- later discovering that the refrigerator may not have been designed or rated for outdoor use;
- not being told before purchase that the refrigerator was a standard indoor or bar model;
- refrigerators failing after being installed outside;
- electrical or GFCI-tripping problems; and
- paying significant amounts to repair or replace components of the outdoor kitchen.
For consumers spending thousands of dollars on an outdoor kitchen, the difference between an indoor refrigerator and an appliance specifically designed for outdoor conditions may be important to the value and durability of the system they purchased.
Migliaccio & Rathod is investigating whether non-outdoor-rated refrigerators were supplied to multiple Paradise Grills customers and whether consumers were clearly informed of the refrigerator’s intended use before agreeing to purchase the kitchen.
Potential Claims May Include:
- failure to disclose that an included refrigerator was not outdoor-rated;
- false or misleading representations concerning outdoor-kitchen components;
- breach of express or implied warranty;
- unfair or deceptive trade practices; and
- damages based on the difference in value between an indoor refrigerator and a comparable outdoor-rated appliance.
