Migliaccio & Rathod LLP is investigating reports that certain NEMO Tensor sleeping pads may begin leaking air prematurely from their welds, dimples, seams, baffles, or valve areas even where the pad has not suffered an obvious puncture.
NEMO Tensor pads are premium backpacking sleeping pads that can cost roughly $150 to $250. Backpackers and campers may rely on these pads in remote locations where an overnight failure can leave them sleeping directly on the ground.
Some NEMO Tensor owners, however, have reported pads losing air after relatively little use, sometimes after only a few nights. Others report receiving warranty replacements that later developed similar leaks.
Consumers Report:
- sleeping pads slowly deflating overnight;
- waking up with the pad substantially or completely flat;
- pinhole leaks appearing around recessed dimples or welded areas;
- seam or baffle failures;
- leaks developing without an identifiable puncture from rocks, sticks, or other outside objects;
- difficulty finding very small leaks;
- pads failing after only a limited number of trips; and
- replacement Tensor pads developing the same or similar problem.
When a leak repeatedly develops at a weld or another structural part of the pad rather than from an outside puncture, consumers may be left repeatedly patching or replacing a product that should withstand ordinary camping use.
Migliaccio & Rathod is investigating whether certain NEMO Tensor sleeping pads share a recurring problem involving their welds, laminates, seams, baffles, valves, or other structural components.
Potential Claims May Include:
- defective design;
- defective weld or laminate construction;
- breach of express or implied warranty;
- failure to adequately disclose premature leakage problems;
- unfair or deceptive trade practices; and
- repair or replacement costs.
Signs You May Be Affected:
- You purchased a NEMO Tensor, Tensor Trail, Tensor All-Season, or related Tensor sleeping pad;
- your pad began losing air during ordinary camping use;
- you could not find an external puncture;
- the leak appeared around a dimple, weld, seam, baffle, or valve;
- the pad failed after relatively few nights or trips;
- NEMO replaced your sleeping pad under warranty; or
- your replacement Tensor later developed the same type of leak.
