Kettle Brand Avocado Oil Chips Investigation

Migliaccio & Rathod LLP is investigating whether consumers who purchased Kettle Brand chips marketed as made with avocado oil received products containing oil inconsistent with authentic avocado oil.

Kettle Brand currently markets a dedicated avocado-oil line, including products such as Made with Avocado Oil Special Sauce Chips, Sea Salt Pink Peppercorn Chips, and Made with Avocado Oil Apple Cider Vinegar Chips. Its ingredient disclosures for at least certain products identify avocado oil as the cooking oil.

Kettle Brand was among the brands whose products were tested in the 2026 UC Davis avocado-oil study. The study as a whole found that 93% of avocado-oil-labeled chip samples had oil profiles inconsistent with authentic avocado oil. Secondary reporting on the study’s product-level results identifies tested Kettle Brand products among those showing compositions inconsistent with authentic avocado oil.

Why Consumers May Have Been Misled

Consumers purchasing Kettle Brand’s avocado-oil products may reasonably understand prominent “Made with Avocado Oil” representations and ingredient lists to mean that avocado oil is the oil used to make the chips.

If laboratory testing shows that the oil in tested products was inconsistent with authentic avocado oil, consumers may have paid a premium based upon an ingredient representation that did not accurately describe the product.

We Are Interested in Hearing From Consumers Who:

  • purchased Kettle Brand avocado-oil chips;
  • purchased Special Sauce, Apple Cider Vinegar, Sea Salt Pink Peppercorn, or another avocado-oil variety;
  • chose the product because it was marketed as made with avocado oil;
  • paid more than they would have for conventional potato chips;
  • relied on an ingredient list identifying avocado oil;
  • sought to avoid other cooking oils; or
  • still possess receipts, packaging, or online purchase records.
