SuperCare Health Data Breach Investigation

Migliaccio & Rathod LLP is currently investigating California-based home respiratory care provider, SuperCare Health (“SuperCare”), for failing to safeguard sensitive patient information in a data breach that occurred in July of 2021. In a notification recently sent to 318,379 potentially impacted patients, SuperCare disclosed that its systems had been the victim of unauthorized activity that began dating back to July 23, 2021. In the notification, SuperCare also confirmed that the information accessed contained patients’ names, address, date of birth, hospital or medical group, patient account number, medical record number, health insurance information, testing/diagnostic treatment information, other health-related information, claim information, Social Security numbers, and driver’s license numbers.

Due to the lapse in time between the data breach and SuperCare’s notice to affected patients, hackers may have already been able to acquire and sell sensitive patient information and otherwise fraudulently misuse it. Victims of data theft are oftentimes forced to spend money on credit monitoring services or to resolve the negative impact of identity theft and/or fraud. Some individuals affected by the SuperCare data breach may have already noticed one or more of the following types of fraudulent activity related to the loss of their personal and healthcare information: suspicious credit card charges, requests for government services or loans, medical procedures ordered without patient consent, and/or disrupted use of the hospital’s patient portal.
