EMC National Life Company Data Breach Investigation

Migliaccio & Rathod LLP is currently investigating EMC National Life Company (“EMC”), for failing to safeguard sensitive customer information in a data breach that occurred in December of 2021. In a notification recently sent to its potentially impacted customers, EMC disclosed that its systems had been the victim of unauthorized activity that allowed unauthorized acquisition of highly sensitive customer information from its network between December 28 – December 30, 2021. In the notification, EMC also confirmed that the information accessed included customers’ full names and one or more of the following: Social Security numbers, taxpayer identification numbers, driver’s license numbers, financial account information, payment card information, date of birth, and medical information.

Due to the lapse in time between the data breach and EMC’s notice to affected customers, hackers may have already been able to sell the acquired information and otherwise fraudulently misuse it. Victims of data theft are oftentimes forced to spend money on credit monitoring services or to resolve the negative impact of identity theft and/or fraud. Some individuals affected by the EMC data breach may have already noticed one or more of the following types of fraudulent activity related to the loss of their personal, financial, and medical information: suspicious credit card charges, requests for government services or loans, medical procedures ordered without patient consent, and/or disrupted use of the hospital’s patient portal.
