Investigation of 2020 Ford F-350 Recall and Payload Decrease

Migliaccio & Rathod LLP is currently investigating Ford Motor Company for their false advertising in the 2020 F-350 trucks after a recall that decreased their payload. At issue are false representations of the vehicle’s payload capacity which, after recall, Ford lowered by almost 500lbs. In early 2021, the National Highway Traffic Safety Administration reported about this recall that it addressed a heightened risk of crash from an overloaded truck bed. Responsive to this risk, Ford had to recalibrate the payload capacity on the Tire and Loading Information (TREAD) Label, which they realized overstated the amount of weight the truck, in truth, could safely accommodate. In doing so, they drastically decreased the advertised functional weight bearing capacity of the vehicle and left consumers financially burdened by a vehicle that no longer meets their expectations. Many owners of the vehicle report feeling victimized by a classic “bait and switch” at the hands of Ford Motor Company as they would not have purchased the vehicle at the newly established payload capacity.

There does not seem to be any clear rationale for the “misprint” of the original sticker labels and we are investigating on behalf of consumers who want to hold Ford accountable.
