Judge Approves Honda Oil Dilution Class Action Settlement

 

On September 11, 2020, Judge Nancy E. Brasel of the federal district court for the District of Minnesota granted final approval to a nationwide class action settlement brought by consumers. The consumers were represented by Migliaccio & Rathod LLP and Sauder Schelkopf, among others. The lawsuit involved 2017-2018 Honda CR-V vehicles equipped with a 1.5 liter turbocharged engine or any 2016-2018 Honda Civic vehicles equipped with a 1.5 liter turbocharged engine. The suit alleged that these vehicles can suffer from a defect that causes fuel dilution of the engine oil, resulting in decreased oil viscosity, premature wear and ultimate failure of the engine, engine bearings, and other internal engine components. Under the terms of the settlement, affected consumers can receive: (1) reimbursement for expenses related to premature oil changes, towing, and past diagnostic costs; (2) a product update, if the consumer lives in certain “cold weather states” where the defect is believed to primarily manifest; and (3) extension of the Powertrain Limited Warranty for up to six years from the original purchase or lease date.
