Judge Approves ASUS Laptop Class Action Settlement Valued at Over $16 Million

On June 22, 2020, Magistrate Judge Donna M. Ryu of the federal district court for the Northern District of California granted final approval to a nationwide class action settlement brought by consumers. The consumers were represented by Migliaccio & Rathod LLP, among others. The lawsuit alleged that two models of ASUS laptops contained defects, namely a “power defect” in which the battery drained and degraded at an accelerated rate and an “overheating defect” in which the laptop overheated, also reducing durability and performance. Under the terms of the settlement, affected consumers could receive a cash payment of up to $110. For one laptop model, the settlement also secured an extended warranty in which ASUS agreed to cover repair and part replacement related to the defect. This relief, alone, was valued at over $16 million.
