Judge Grants Final Approval of $16.5 Million Nationwide Class and Collective Settlement in Bob Evans Overtime Litigation

Migliaccio & Rathod LLP is thrilled to announce that Magistrate Judge Norah McCan King of the United States District Court of the Southern District of Ohio has granted final approval to a $16.5 million settlement in the case Snodgrass v. Bob Evans, Inc. Nicholas Migliaccio and Jason Rathod actively litigated the case with co-counsel from when it was filed in 2012. The lawsuit alleged that Bob Evans, a restaurant chain with hundreds of locations predominantly in the Midwest, had misclassified its Assistant Managers as exempt from federal and state overtime laws. With the settlement, the gross recovery per class member will be $6,380. In issuing its order, the court took special note of the “competence of class counsel in prosecuting this complex litigation, and the risks associated with the prosecution of the claims of the settlement class.”
