Migliaccio & Rathod LLP is involved in the Fidelity Investments Data Breach Investigation that affected 77,099 individuals and their personal information.
On August 19, 2024, Fidelity Investments (“Fidelity”) discovered that an unauthorized third-party had gained access to the private information of its customers by using “two customer accounts that they had recently established.” While it is unclear how the cybercriminals used the accounts to facilitate the data breach, Fidelity reported that only a “small subset” of individuals were affected by the cyberattack that occurred between August 17, 2024, and August 19, 2024. Fidelity failed to disclose the types of personally identifiable information impacted by the data breach, but nevertheless asserted that no customer accounts were affected.

Fidelity Investments recently sent notification to affected customers informing them of the data breach. All of the information stolen is likely valuable and dangerous to affected victims. As is likely to be the case with the Fidelity data breach, in previous cyber-attacks, victims of data theft have noticed identity theft attempts ranging from fraudulent charges on bank accounts or credit cards, to unauthorized credit card applications, to medical services or government services ordered in their name, to their information being posted on the dark web, to a massive uptick in the number of spam text messages, calls and emails received.
