Are you disabled with student loans? Not enough student loan borrowers are benefiting from disability loan forgiveness. The Federal Department of Education and the major loan serving companies – FedLoan Servicing (PHEAA), Great Lakes Educational Loan Services, Inc., Edfinancial, MOHELA, Aidvantage, Nelnet, OSLA, ECSI; and others – offer a way for disabled borrowers to have their student loans discharged. This is called Total and Permanent Disability loan forgiveness, or TPD.
However, loan servicers, including Nelnet, have made the process overly complicated. Many people who qualify for TPD loan forgiveness do not benefit from it. The servicers may have accepted applications, only to rescind those acceptances later. They may not have coordinated with the Department of Veterans Affairs (VA) or the Social Security Administration (SSA) to identify disabled borrowers. They may also have been negligent in transferring TPD-eligible loans between loan servicers, a practice criticized by the Consumer Financial Protection Bureau.
If you have student loans, are permanently disabled, but are still being bothered by loan collectors, you could have legal claims.
Have applied for disability loan forgiveness (TPD)? Has the SSA or the VA declared you permanently disabled, but student loan servicers still try to collect on your debt?
If so, we would like to hear from you! Please complete the questionnaire on this page, send an email to [email protected], or give us a call at (202) 470-3520.
