Children’s Online Privacy Investigation

 

Migliaccio & Rathod LLP is currently investigating potential infringements of students’ online privacy due to remote learning measures enacted amidst the COVID-19 outbreak. The FTC reminds educators that, while education technology can fill a vital role in facilitating distance learning, many relevant services collect and use students’ personal information. The Children’s Online Privacy Protection Act (COPPA) restricts websites and online services’ data practices pertaining to children under the age of thirteen. The law requires that online services clearly disclose their practices for data collection, use, and disclosure, and obtain parental consent prior to their implementation. Educators can consent on parents’ behalf, but only if the collected information is used for educational, rather than commercial, purposes. The FTC advises educators to “give parents a notice of the websites and online services whose collection they have consented to on behalf of the parent.”
