Migliaccio & Rathod LLP is investigating reports of a potentially dangerous power seat defect in certain 2026 Hyundai IONIQ 9 vehicles that may cause second-row seats to continue moving even when a person or object is in the way.
The 2026 Hyundai IONIQ 9 is equipped with power-operated second-row seats, including automatic power fold-and-stow functions designed to make it easier for passengers to access and configure the rear seating area. However, instead of detecting something or someone and stopping, an affected seat may continue moving after contact. This can create a serious risk where someone inside the vehicle could become trapped or injured by the moving seat. The problem may be particularly concerning for families with young children that may accidentally press a seat-control button.
Hyundai has issued Recall 307 (NHTSA Campaign 26V588) covering approximately 5,360 model-year 2026 Hyundai IONIQ 9 vehicles equipped with Limited, Calligraphy, or Calligraphy Design trim packages.
Migliaccio & Rathod LLP is investigating whether Hyundai’s software-based recall remedy adequately addresses the power-seat defect and whether affected IONIQ 9 owners have experienced continued or new seat-related problems following the recall update.
Owners May Have Experienced:
- Second-row power seats continuing to move after contacting a person;
- Children or adults becoming trapped, pinned, or compressed by a moving seat;
- Seats failing to properly detect an occupant during powered operation;
- A seat continuing to move during automatic power fold-and-stow operation;
- Unexpected or concerning operation of the second-row power seats; and
- Concerns about safely using the second-row seating area while awaiting the recall repair.
Potential Claims May Include:
- Defective design;
- Failure to provide adequate obstruction or anti-pinch protection;
- Failure to adequately warn consumers;
- Breach of warranty;
- Loss of vehicle value or advertised functionality; and
- Violations of applicable consumer-protection laws.
