Migliaccio & Rathod LLP is investigating Virgin Voyages over concerns that passengers may have been misled about whether gratuity charges were mandatory or optional when booking cruises.
Beginning in October 2025, Virgin Voyages changed its pricing structure so that gratuities were no longer included in certain cruise fares. Passengers could pay gratuities during booking or onboard, but prepaid gratuities were generally non-refundable.
Migliaccio & Rathod LLP is investigating whether passengers understood that gratuities could be modified or removed before disembarkation and whether they were adequately informed that prepaid gratuities were nonrefundable.
Consumers May Have Experienced:
- Paying gratuities they believed were mandatory;
- Unexpected additional charges during booking or onboard;
- Paying nonrefundable gratuities without understanding the refund policy;
- Confusion about their ability to adjust or remove gratuity charges.
Potential Claims May Include:
- Consumer protection law violations;
- False or misleading advertising;

- Breach of contract.

- You booked a Virgin Voyages cruise after October 2025;
- You paid gratuities because you believed they were required;
- You prepaid gratuities without understanding they were nonrefundable;
