Migliaccio & Rathod LLP is investigating whether CVS Pharmacy has complied with California’s consumer protection laws in connection with its paid CVS ExtraCare Plus membership program.
CVS Pharmacy states that it sends members a reminder email before the CVS ExtraCare Plus renewal date. Its published terms also generally require cancellation at least three days before renewal and provide that membership fees are not refunded after the recurring charge has been processed.
California law generally requires a renewal notice 15 to 45 days before a covered annual subscription renews. The notice must include important information about the upcoming charge and cancellation options.
Migliaccio & Rathod is seeking information about whether CVS Pharmacy consistently delivers the required renewal notices regarding CVS ExtraCare Plus to California consumers, whether those notices contain all required information, and whether customers are afforded an effective opportunity to avoid unwanted charges.
