Migliaccio & Rathod LLP is investigating whether hourly employees at Frito-Lay Aberdeen, Maryland facility were fully paid for all required pre-shift and post-shift work activities.
Frito-Lay operates manufacturing and distribution facilities staffed by hourly employees, and PepsiCo continues to identify Aberdeen as one of its employment locations. Frito-Lay also separately recruits hourly workers for manufacturing-facility roles.
At large production and distribution facilities, employees may be required to spend time reaching assigned areas, obtaining equipment or safety gear, complying with facility procedures, or returning equipment after their scheduled work ends.
What Workers Report
Workers may report:
- Walking long distances before clocking in or after clocking out;
- Being required to arrive early to reach production, warehouse, loading, or distribution areas;
- Time spent walking between parking areas, entrances, timeclocks, and assigned work locations;
- Time spent obtaining protective equipment, safety gear, or work equipment before paid time begins;
- Time spent returning equipment or leaving production and distribution areas after paid shifts end;
- Time spent waiting at required entrances or checkpoints before reaching work areas; or
- Not being paid for all time spent performing required activities on Frito-Lay property.
Why Workers Should Be Concerned
Hourly workers generally must be paid for all compensable work time. Employees who are required to perform activities before clocking in or after clocking out may be entitled to additional wages, including overtime where the unpaid time causes their workweek to exceed 40 hours.
Potential claims may include:
- Unpaid wages;
- Unpaid overtime;
- Failure to pay for required pre-shift and post-shift activities; and
- Wage-and-hour violations.
