Migliaccio & Rathod LLP is investigating reports that certain ICON EV and related golf carts equipped with first-generation AGM battery systems may experience premature battery failures potentially associated with the cart’s charging system or charger programming.
The investigation is focused particularly on certain 2022–2023 ICON EV and EPIC electric vehicles equipped with AGM battery packs.
While batteries naturally lose capacity over time, some ICON EV owners have described something more significant: entire battery packs failing unusually early, replacement batteries failing again, and dealers allegedly identifying problems with how the vehicle’s charger was programmed for the installed batteries.
Consumers Report:
- AGM batteries failing after approximately a year or less;
- substantial loss of driving range;
- carts no longer holding a charge;
- multiple batteries failing together;
- receiving an entire replacement battery pack;
- replacement batteries later developing similar problems;
- dealers reprogramming or adjusting the onboard charger;
- paying pickup, transportation, labor, or diagnostic charges even when replacement batteries were covered; and
- being told to purchase an expensive lithium battery upgrade after recurring AGM problems.
One reported owner stated that a dealer replaced six batteries and reprogrammed the charger after the original AGM pack failed. Another report described batteries failing after six months, followed by another failure only two months after replacement. In responding to that second complaint, ICON EV reportedly acknowledged that there could be an issue with either charging or the programming of the cart.
Why the Charger May Matter
An electric-vehicle battery pack depends on the charging system applying the correct charging profile.
If a charger is improperly configured for the type of batteries installed in a vehicle, consumers may experience premature battery degradation even though the batteries themselves are repeatedly replaced.
Migliaccio & Rathod is investigating whether certain ICON EV or EPIC carts may have left the factory with charger settings or programming that were not properly matched to their AGM batteries and whether this contributed to repeated battery failures.
Potential Claims May Include:
- defective charging-system programming;
- defective battery or charging-system design;
- breach of express or implied warranty;
- failure to provide an effective repair;
- failure to adequately disclose a recurring battery or charging problem;
- unfair or deceptive trade practices; and
- damages associated with battery replacement, labor, transport, loss of use, or lithium upgrades.
Signs You May Be Affected:
- You purchased a 2022–2023 ICON EV or EPIC golf cart equipped with AGM batteries;
- your original batteries failed substantially earlier than expected;
- several or all batteries had to be replaced at once;
- replacement batteries later failed again;
- your dealer reprogrammed, recalibrated, or changed the charging settings on your cart;
- a dealer told you there was a charger-programming problem;
- you paid labor, pickup, delivery, or diagnostic charges despite receiving warranty batteries; or
- you ultimately paid to convert the vehicle to lithium batteries after repeated AGM failures.
If possible, please retain your repair orders, battery model information, charger information, serial number, and communications with the dealer or ICON, particularly any document mentioning charger programming or reprogramming.
