Migliaccio & Rathod LLP is investigating reports that Not A Wheelchair Paradox Project wheelchairs may experience premature failures involving wheels, bearings, casters, or other components used during everyday mobility.
The Not A Wheelchair Paradox Project is marketed as a lightweight manual wheelchair intended to provide an affordable alternative to substantially more expensive custom wheelchairs. Consumers who depend on a wheelchair every day may reasonably expect its essential components to remain reliable under ordinary use.
Some owners, however, have reported repeated maintenance or component problems, including issues involving bearings and other moving parts.
Consumers Report:
- bearings wearing out or requiring replacement;
- wheels or other moving components developing problems;
- components becoming loose or requiring repeated adjustment;
- needing repairs or replacement parts sooner than expected;
- recurring maintenance issues affecting normal wheelchair use; and
- concerns about the durability of components used on the chair.
For a consumer who relies on a wheelchair as an everyday mobility device, repeated failures can result in more than repair expenses. A malfunctioning chair can interfere with work, transportation, errands, and other daily activities.
Migliaccio & Rathod is interested in hearing from Not A Wheelchair Paradox Project owners who have experienced repeated or unusually early component failures, particularly where the same component has required multiple repairs or replacements.
Potential Claims May Include:
- defective or insufficiently durable components;
- breach of express or implied warranty;
- failure to provide an adequate repair or replacement;
- failure to adequately disclose recurring durability problems; and
- unfair or deceptive trade practices.
