Migliaccio & Rathod LLP is investigating whether consumers who purchased Simply Tostitos Sea Salt & Avocado Oil Tortilla Chips received products containing oil that was inconsistent with authentic avocado oil.
Simply Tostitos markets its Sea Salt & Avocado Oil tortilla chips as being cooked in avocado oil, making the type of cooking oil a prominent feature of the product. Consumers may choose these chips—and pay a premium for them—because they believe avocado oil is being used instead of more conventional cooking oils.
A 2026 study from researchers at the University of California, Davis raises questions about the authenticity of avocado oil used in processed foods. Researchers tested 54 products that identified avocado oil as the only oil ingredient and found that 48 of the 54 products had oil compositions inconsistent with authentic avocado oil. Among chips, 26 of the 28 samples tested failed the researchers’ authenticity criteria.
Importantly, reported results for Simply Tostitos appear to have varied between tested samples. One tested sample reportedly had an oil profile consistent with authentic avocado oil, while another did not. This raises potential questions about batch-to-batch consistency and whether consumers purchasing the same avocado-oil-labeled product always received what the label represented.
Why Consumers May Have Been Misled
Consumers purchasing Simply Tostitos Sea Salt & Avocado Oil chips may reasonably expect that the product is cooked with authentic avocado oil, particularly because avocado oil is expressly highlighted in the product’s name and marketing.
If some batches contained oil inconsistent with authentic avocado oil, consumers may have paid a premium based on a representation that was not consistently true across the products sold.

- chose the chips specifically because they were marketed as cooked in avocado oil;
- paid more for them than they would have paid for conventional tortilla chips;
- specifically sought to avoid other vegetable or seed oils;
- purchased the product repeatedly;
- noticed differences between bags or batches;
- still have product packaging, including the lot or date code;
- have receipts, photographs, or online purchase records; or
- would have paid less—or not purchased the product—had they known the cooking oil might not be authentic avocado oil.
