Migliaccio & Rathod LLP recently filed a class action complaint on this matter in the Northern District of California in the case Waller V. Tesla, Inc. Et Al (3:26cv5350).
Migliaccio & Rathod LLP is investigating Tesla vehicles equipped with Hardware 1, Hardware 2, Hardware 2.5, and Hardware 3 following reports that these vehicles may be incapable of achieving the fully autonomous driving capabilities that Tesla repeatedly represented they would support.
Reported Issues
Consumers report:
- Purchasing Tesla vehicles after being told that the vehicles contained all hardware necessary for future Full Self-Driving functionality.
- Paying thousands of dollars for Tesla’s Full Self-Driving (“FSD”) package or FSD Capability option.
- Purchasing vehicles based on representations that future software updates would enable fully autonomous driving.
- Learning that Hardware 3 vehicles may require substantial hardware replacements, including new computers and cameras, to achieve Tesla’s promised autonomous-driving capabilities.
- That Tesla represented its vehicles as having hardware capable of supporting fully autonomous driving, robotaxi functionality, and driverless operation.
- That Tesla’s Full Self-Driving technology has not achieved the autonomous capabilities that consumers were led to expect.
- That they would not have purchased their Tesla vehicle, or would have paid less, had they known the vehicles lacked the hardware necessary to achieve the promised functionality.
