After Hours Debt Collection Communications Investigation

Migliaccio & Rathod LLP is currently investigating allegations that corporations are contacting D.C. residents after hours in an attempt to collect a consumer debt in violation of D.C. law.

Pursuant to D.C. law debt collectors or creditors are prohibited from communicating with consumers concerning a consumer debt that is allegedly 30 days past due during the hours of 9:00PM through 8:00AM EST. In addition to violating D.C. law, these off hours communications by a debt collector might also violate federal law.

The purpose of the D.C. debt collection law and its federal law counterpart, the Fair Debt Collection Practices Act is to protect consumers from unfair and harassing tactics of debt collectors in collecting a consumer debt.
