Migliaccio & Rathod LLP recently filed a class action complaint against the Cape Canaveral, Florida-based Acuity-CHS, LLC d/b/a Comprehensive Health Services, LLC (“Comprehensive Health Services”) for failing to safeguard sensitive patient information in a data breach that occurred in November of 2021. Comprehensive Health Services provides occupational health services, including pre-employment medical screening and evaluations, to agencies within the US Department of Homeland Security.
After the data breach, Comprehensive Health Services sent notification letters to potentially affected patients alerting them to the loss of their information. Exactly what information may have been affected in the case of each individual, however, still remains unknown. In many data breaches, the lapse in time between the breach and the company’s notice to affected patients allows hackers to acquire and sell sensitive patient information such as social security numbers. In previous data breaches, victims of data theft have been forced to spend money on credit monitoring services or to resolve the negative impact of identity theft and/or fraud. Some individuals affected by the data breach may have noticed one or more of the following types of fraudulent activity related to the loss of their personal and healthcare information: requests for government services or loans, medical procedures ordered without patient consent, and fraudulent bank/credit card charges.
