Savage x Fenty Deceptive Marketing Investigation

 

Migliaccio & Rathod LLP is currently investigating Savage x Fenty for its use of deceptive marketing techniques that includes negative-option offers. When terms and conditions are made clear to the consumer, they could find themselves renewing products they otherwise thought were free to try, without opting into a subscription. The negative-option model sees consumers taking more steps to end a subscription they didn’t knowingly opt-in for, or otherwise continue facing charges. Other examples of deceptive marketing include:

  • “Deceptively promoting discounts and product prices that are only available to Xtra VIP members who are bound to the terms of the membership;
  • Enrolling consumers into a negative-option offer without disclosing all the material terms and conditions of the offer;
  • Falsely telling consumers that store credits can be used “whenever they want”; and
  • Employing dissuasion and diversion tactics when consumers try to cancel their Savage X Fenty membership.”
