Migliaccio & Rathod is investigating situations where dealer employees allegedly made specific representations that a customer needed to reach a particular purchase history, buy certain merchandise, or make additional purchases before receiving a desired Rolex allocation.
The investigation is particularly focused on customers who were given specific promises or measurable conditions, such as being told that a certain amount of additional spending would qualify them for a watch, that they held a particular position in line, or that purchasing specified merchandise would result in receiving the next available watch.
Consumers May Have Experienced:
- Being told that purchase history was required to receive a scarce Rolex;
- Being asked to purchase jewelry, Tudor watches, other watches, or other merchandise before receiving an allocation;
- Being told that spending a particular amount would move them higher in priority;
- Being given a specific position on a purported waitlist;
- Being promised a particular Rolex after making additional purchases; or
- Making substantial purchases but never receiving the promised watch.
Potential Claims May Include:
- False or misleading representations;
- Unfair or deceptive trade practices;
- Fraud or negligent misrepresentation, depending on the circumstances;
- Unjust enrichment;
- Recovery of losses associated with induced purchases; and
- Other applicable consumer-protection claims.
Signs You May Be Affected:
- You sought a Rolex from an authorized dealer;
- A salesperson told you that additional purchases would improve or guarantee your allocation;
- You purchased jewelry, watches, or other merchandise because of that representation;
- You were given a specific spending target, waitlist position, or promised delivery;
- You never received the watch you were promised; or
- You have texts, emails, WhatsApp messages, voicemails, receipts, or other documentation of the representation.
