Migliaccio & Rathod LLP is investigating whether Rolex owners may have had otherwise valid warranty claims denied because their watches were previously opened, repaired, modified, or serviced by independent watchmakers.
Rolex warranty materials exclude certain damage or functional problems associated with unauthorized repairs, opening or manipulation by non-authorized personnel, and the use of non-genuine Rolex components. A manufacturer may generally refuse to cover damage actually caused by unauthorized work. Migliaccio & Rathod is investigating a narrower issue: whether Rolex has treated any prior independent service or modification as grounds to void the entire remaining warranty, even when the later warranty problem was unrelated to that work.
For example, an owner may have had an independent watchmaker replace a bracelet component, gasket, crystal, or other part and later experienced an unrelated internal mechanical defect. The investigation concerns whether Rolex denied coverage for the unrelated defect solely because the watch had previously been serviced or modified outside the authorized network.
Owners May Have Experienced:
- Having a Rolex opened or serviced by an independent watchmaker;
- Installing a non-Rolex bracelet, crystal, bezel, or other component;
- Later experiencing a separate mechanical or manufacturing problem;
- Being told that prior independent work invalidated the remaining Rolex warranty;
- Having warranty service denied for a problem unrelated to the independent repair; or
- Paying out of pocket for repairs that otherwise would have been covered.
Potential Claims May Include:
- Improper warranty restrictions;
- Violations of the Magnuson-Moss Warranty Act;
- Breach of warranty;
- Unfair or deceptive trade practices;
- Recovery of improperly denied repair expenses; and
- Recovery of other economic losses associated with lost warranty coverage.

- You purchased a Rolex with remaining factory warranty coverage;
- Your watch was previously opened, serviced, or modified by an independent watchmaker;
- Rolex later refused to cover an unrelated defect;
- The denial referenced unauthorized repair, opening, or non-genuine parts;
- You paid for a repair that you believed should have been covered; or
- You have a Rolex service estimate, warranty denial, or written explanation showing why coverage was refused.
