Booking.com Personalized Hotel Pricing Investigation

Migliaccio & Rathod LLP is investigating whether Booking.com users may be shown different hotel prices, discounts, or promotional offers based on account information, browsing behavior, travel history, or other personal data.

Online travel platforms frequently use customer information to personalize search results, recommendations, and promotions. Migliaccio & Rathod is investigating whether this personalization may also affect the economic terms shown to individual travelers, including hotel rates, purported discounts, or promotional prices.

The investigation is particularly focused on situations where two consumers search for the same hotel, room type, dates, and occupancy at approximately the same time but receive materially different prices or discounts.

The available research identifies Booking.com as a possible personalized-pricing target, although the current evidence is less developed than for the grocery and rideshare investigations.

Consumers May Have Experienced:

  • Seeing a different hotel price than another Booking.com user for the same stay;
  • Receiving different prices when logged into an account compared with searching while logged out;
  • Receiving account-specific discounts or promotional prices;
  • Seeing prices change after repeatedly searching for the same hotel;
  • Receiving a purported discount based on a different reference price than another traveler; or
  • Paying more than another similarly situated Booking.com customer for an identical reservation.

Potential Claims May Include:

  • Failure to adequately disclose individualized pricing practices;
  • Misleading presentation of personalized discounts;
  • False or misleading reference pricing;
  • Unfair or deceptive trade practices;
  • Unjust enrichment; and
  • Violations of applicable state consumer-protection laws.

  • You booked or searched for hotels through Booking.com;
  • You compared the same hotel with another traveler and saw different prices;
  • Your price changed depending on whether you were logged in;
  • Your account received a personalized discount or promotion;
