Polaris MATRYX 650 and 850 Clutch Recall Investigation

Migliaccio & Rathod LLP is investigating whether certain Polaris MATRYX snowmobile owners suffered additional losses after completing an earlier drive-clutch recall repair and later being required to stop riding or obtain a second repair.

The investigation concerns certain Polaris MATRYX snowmobiles equipped with Patriot 650 and 850 engines and affected by drive-clutch safety actions.

The reported defect involves a drive-clutch post that may crack and allow clutch components to separate from the snowmobile. Public recall information identifies 133 reported clutch failures, including 12 reports involving component separation and reports of injuries.

Of particular concern, when Polaris MATRYX expanded the recall population, the company and CPSC indicated that some owners whose snowmobiles had already been repaired could require another repair.

Consumers May Have Experienced:

  • completing the original Polaris clutch recall repair;
  • believing the clutch problem had been corrected;
  • later receiving another stop-ride or repair notice;
  • having to return the snowmobile to a dealer for a second repair;
  • losing use of the snowmobile during part of the riding season;
  • waiting weeks for replacement parts or dealer availability;
  • paying transportation, trailer, rental, or substitute-snowmobile expenses; or
  • experiencing another clutch problem after the first recall repair.

For snowmobile owners, timing can be especially important. A repair delay that consumes several weeks of a short winter riding season may represent a meaningful loss of use even if the eventual replacement part is provided at no charge.

Potential Claims May Include:

  • failure to provide an effective initial recall remedy;
  • breach of warranty;
  • unfair or deceptive trade practices;
  • repeated repair expenses;
  • transportation or substitute-vehicle costs; and
  • loss-of-use damages where available.

Signs You May Be Affected:

  • You own or previously owned an affected Polaris MATRYX snowmobile with a Patriot 650 or 850 engine;
  • you completed an earlier drive-clutch recall repair;
  • Polaris later instructed you to obtain another clutch repair;
  • you were told to stop riding while waiting for the second repair;
  • you lost a significant portion of the riding season;
  • you incurred trailer, transportation, rental, or substitute-snowmobile costs; or
  • the clutch failed or developed another problem after an earlier recall repair.
