TiLite Aero T Wheelchair Frame Failure Investigation

Migliaccio & Rathod LLP is investigating reports that TiLite Aero T wheelchairs may develop cracks or structural failures in the front portion of the wheelchair frame near the caster wheels.

Consumers rely on wheelchair frames to withstand the repeated stresses of everyday movement. Reports concerning the TiLite Aero T wheelchairs describe cracks and breaks occurring in a similar area of the chair—at or immediately above the front caster region. Some consumers have reported experiencing more than one failure in this general location.

Other reported failures have occurred suddenly while the TiLite Aero T wheelchairs were being used, potentially leaving the chair unsafe or unusable.

Consumers Report:

  • cracks developing in the front wheelchair frame;
  • frame failures immediately above or near a caster;
  • repeated failures occurring in the same general area;
  • sudden breaks after relatively ordinary bumps or surface irregularities;
  • deformation around the caster or front-frame area; and
  • wheelchairs becoming unsafe or unusable after the frame fails.

Migliaccio & Rathod is investigating whether these reported failures may reflect a recurring durability, fatigue, design, or manufacturing problem affecting certain TiLite Aero T wheelchairs.

  • manufacturing defects;
  • premature metal fatigue;
  • breach of express or implied warranty;
  • failure to adequately disclose a recurring structural problem; and
  • unfair or deceptive trade practices.

  • You own or previously owned a TiLite Aero T wheelchair;
  • your wheelchair frame cracked or broke near one of the front casters;
  • the failure occurred during ordinary use;
  • you experienced more than one frame failure in the same area;
  • your wheelchair required a new frame or substantial structural repair; or
  • the failure occurred even though you were using the wheelchair within its intended specifications.
