Migliaccio & Rathod LLP is investigating whether Roadie misclassified delivery drivers as independent contractors while controlling assignments, delivery timing, proof-of-delivery requirements, and route tracking.
What Workers Report
Drivers report:
- Delivering lost airline baggage, same-day retail orders, and other time-sensitive goods.
- Being assigned jobs and delivery prices through the Roadie platform.
- Having their location tracked from pickup to drop-off.
- Being required to submit real-time photo proof at delivery.
- Working strict delivery windows with penalties or consequences for lateness.
- Driving long distances, including across state lines.
- Paying their own fuel, tolls, insurance, maintenance, and vehicle wear.
- Receiving no overtime or mileage reimbursement.
Why Workers Should Be Concerned
Delivery drivers may be misclassified when a company controls pricing, assignments, tracking, delivery standards, and proof-of-delivery requirements. Drivers who pay major vehicle expenses out of pocket may be earning less than legally required.
Potential claims may include:
- Worker misclassification
- Failure to reimburse mileage and vehicle expenses
- Failure to pay minimum wages
- Failure to pay overtime
- Wage theft
- Labor protection violations
Signs You May Be Affected
You may be affected if:
- You delivered baggage, retail orders, or same-day goods through Roadie.
- Roadie set the delivery price or assigned jobs.
- You were required to provide in-app photo proof.
- You were tracked by GPS during deliveries.
- You paid for fuel, tolls, maintenance, or insurance yourself.
- You worked more than 40 hours without overtime pay.
