Migliaccio & Rathod LLP is investigating whether Shipt misclassified shoppers who deliver groceries for Target, Giant Food, and other retailers as independent contractors while controlling their work through pay algorithms, performance ratings, shopping rules, and account deactivation policies.

What Workers Report

Shipt shoppers report:

  • Accepting grocery orders through the Shipt app.
  • Shopping for groceries at Target, Giant Food, or other stores.
  • Paying for items using their own credit cards before reimbursement or processing.
  • Following detailed company instructions for bagging, receipt handling, and delivery.
  • Paying for gas, parking, insulated bags, reusable totes, and other expenses.
  • Being graded based on speed and customer ratings.
  • Facing frozen accounts or deactivation based on performance metrics.
  • Working long shifts during peak demand without overtime pay.

Why Workers Should Be Concerned

Shoppers may be denied employment protections if they are classified as contractors while the company controls pay, ratings, shopping rules, delivery procedures, and access to work. Out-of-pocket expenses may also reduce actual earnings below minimum wage.
