Migliaccio & Rathod LLP y Townsend Legal, PLLC presentaron una demanda colectiva contra Global Federal Credit Union (GCU). La demanda alega que GCU niega la membresía, las cuentas de depósito y el crédito a personas que no son ciudadanas, incluidos inmigrantes con presencia legal y autorización para trabajar, por motivo de su origen nacional, raza, condición de extranjero y situación migratoria, y que esta conducta afecta en particular a solicitantes de origen mexicano, latino e hispano.
Los dos demandantes, ambos de origen nacional mexicano, alegan que GCU los rechazó a pesar de que cumplían con todos los requisitos de identificación que GCU publica para abrir una cuenta bancaria u obtener un préstamo. GCU negó ilegalmente sus solicitudes con base en su situación migratoria. Otros consumidores han presentado quejas similares ante la Oficina para la Protección Financiera del Consumidor (CFPB, por sus siglas en inglés), en las que describen un trato parecido, y alegan que la conducta de GCU refleja una política o práctica de discriminación basada en la situación migratoria, el origen nacional o la raza del solicitante. Migliaccio & Rathod LLP and Townsend Legal, PLLC have filed a class action lawsuit against Global Federal Credit Union (GCU). The suit alleges that GCU denies membership, deposit accounts, and credit to noncitizens, including lawfully present, work-authorized immigrants, because of their national origin, race, alienage, and immigration status, and that this conduct targets applicants of Mexican, Latino, and Hispanic background.
The two Plaintiffs, both of Mexican national origin, have alleged that GCU turned them away despite satisfying every identification requirement GCU publishes to open a bank account or obtain a loan. GCU unlawfully denied their applications, citing immigration status. Other consumers have made similar complaints to the Consumer Financial Protection Bureau describing similar treatment and allege that GCU’s conduct reflects a policy or practice of discrimination based on the immigration status, national origin, and/or race of the applicant.
