Migliaccio & Rathod LLP is investigating potential defects affecting certain nonrecalled SABRE pepper spray and pepper gel products, including reports of canisters failing to discharge properly when activated.
Consumers purchase SABRE pepper sprays and gels expecting them to work when needed for personal protection. However, some owners have described problems with spray mechanisms, buttons, or actuators that prevent the products from dispensing properly. A separate 2023 recall involving approximately 4,000 SABRE Aim & Fire Pepper Gel units identified a missing-nozzle issue that could prevent those recalled products from operating in an emergency.
Migliaccio & Rathod is investigating whether other SABRE pepper spray or gel products, outside the previously recalled population, have experienced similar discharge or activation failures that could make them unreliable during intended use.
Consumers May Have Experienced:
- Pepper spray or gel failing to discharge when activated;
- Spray buttons or actuators not functioning properly;
- Canisters releasing little or no spray despite containing product;
- Having to press the actuator repeatedly to dispense spray;
- Discovering that the product would not function during testing or intended use; or
- Replacing a SABRE product because its spray mechanism failed.
Potential Claims May Include:
- Defective spray or actuator mechanisms;
- Breach of express or implied warranties;
- Failure to disclose known product defects;
- Misrepresentations concerning product reliability; or
- Violations of state consumer protection laws.
Signs You May Be Affected:
- You purchased a SABRE pepper spray or pepper gel product;
- Your product was not included in the previously announced Aim & Fire recall;
- The spray failed to discharge when you pressed the actuator;
- The canister contained product but did not spray properly;
- You had to replace the product because of a discharge failure; or
- You purchased the product from a physical retail store.
