Whiting-Turner Unpaid Hours and Overtime Investigation

Migliaccio & Rathod LLP is investigating whether The Whiting-Turner Contracting Company failed to pay certain hourly employees for all hours worked and may have underpaid overtime compensation.

Employees generally must be paid for all compensable time they perform work for their employer. Hourly Whiting-Turner employees who work more than 40 hours during a workweek also generally must receive overtime compensation.

Migliaccio & Rathod is investigating reports that certain Whiting-Turner employees may have recorded more than eight hours of work but nevertheless been paid for only eight hours. The investigation also concerns whether bonuses, guaranteed payments, or other compensation were properly accounted for when employees’ overtime rates were calculated.

If employees’ recorded hours were reduced or excluded from their paychecks, affected workers may have been deprived of both their regular wages and additional overtime compensation.

Employees May Have Experienced:

  • Recording more than eight hours of work but being paid for only eight hours;
  • Having hours appearing on a timecard excluded from a paycheck;
  • Working before or after their paid shift without compensation;
  • Working more than 40 hours without being paid for every hour worked;
  • Receiving guaranteed payments or other additional compensation while working overtime; and
  • Discrepancies between time records and the number of hours shown on paystubs.

Potential Claims May Include:

  • Failure to pay for all hours worked;
  • Unpaid overtime;
  • Improper alteration or reduction of Whiting-Turner employee work hours;
  • Failure to properly calculate overtime compensation;
  • Violations of the Fair Labor Standards Act; and
  • Violations of applicable state wage laws.
