Migliaccio & Rathod LLP is investigating whether Parkview Health properly paid hourly employees for all hours worked and correctly calculated overtime when employees received shift differentials, incentive pay, bonuses, or other additional compensation.
Reports provided for this investigation raise two potential wage concerns. Certain Parkview Health employees reportedly received shift differentials, performance or sign-on bonuses, guaranteed pay, hero or incentive pay, and other additional compensation, while another report alleges that employees were not always paid for all hours worked.
Parkview Health employees frequently receive compensation above their ordinary hourly wage for working particular shifts, taking extra assignments, remaining employed for specified periods, or meeting other predetermined conditions.
Under federal law, certain forms of this additional compensation generally must be included when calculating a Parkview Health employee’s regular rate for overtime purposes.
Employees must also generally be paid for all compensable hours they perform work for their employer.
Employees May Have Experienced:
- Receiving overnight, evening, weekend, or other shift differentials;
- Receiving performance, sign-on, retention, guaranteed, or other incentive payments;
- Receiving additional pay for taking extra shifts;
- Working more than 40 hours during weeks associated with additional compensation;
- Having overtime calculated only from the base hourly wage; and
- Performing compensable work that did not appear on a paycheck.
Potential Claims May Include:
- Failure to include qualifying bonuses or differentials in the regular rate;
- Underpayment of overtime compensation;
- Failure to pay for all hours worked;
- Unpaid off-the-clock work;
- Violations of the Fair Labor Standards Act; and
- Violations of applicable state wage laws.

- You worked for Parkview Health as an hourly employee;
- You received shift differentials, bonuses, incentive pay, or extra-shift compensation;
- You worked more than 40 hours during weeks when you received additional compensation;
- Your overtime rate was based only on your normal hourly wage;
