Migliaccio & Rathod LLP is investigating potential wage violations involving hourly employees of Able Industrial Services and related industrial contractors, including reports involving ParFab Field Services and Integrated Specialty Services.
Reports provided for this investigation indicate that certain employees may have received performance or guaranteed bonus compensation while also performing work outside their paid or recorded hours.
Industrial and construction employees may work long shifts and receive bonuses, guaranteed payments, or other additional compensation tied to projects or performance. Certain nondiscretionary payments generally must be included when calculating overtime.
Able Industrial employees must also generally be paid for all compensable work their employer requires or permits them to perform.
Migliaccio & Rathod is investigating both the calculation of overtime and reports of unpaid off-the-clock work.
Employees May Have Experienced:
- Receiving performance, guaranteed, or other recurring bonus compensation;
- Working more than 40 hours during weeks when bonuses were earned;
- Having overtime calculated only from the base hourly wage;
- Performing work before clocking in or after clocking out;
- Working through unpaid periods without compensation; and
- Having required work omitted from recorded hours.
Potential Claims May Include:
- Failure to include qualifying bonuses in the regular rate;
- Underpayment of overtime compensation;
- Unpaid off-the-clock work;
- Failure to pay for all hours worked;
- Violations of the Fair Labor Standards Act; and
- Violations of applicable state wage laws.

- You regularly worked more than 40 hours per week;
