Molina Healthcare Nurse Off-the-Clock Work Investigation

Migliaccio & Rathod LLP is investigating whether Molina Healthcare Medical Review Nurses, Care Review Clinicians, and similar utilization-management employees may have performed unpaid work before, after, or during their scheduled shifts because of high case volumes, documentation requirements, or turnaround-time expectations.

Unlike some utilization-review investigations involving salaried nurses, current Molina Healthcare postings show that many of these positions are expressly paid hourly.

For example, an August 25, 2026 posting for a remote Medical Review Nurse (RN) lists compensation of $29.05 to $56.64 per hour. The role requires nurses to review documentation for medical necessity and appropriate levels of care using MCG/InterQual, state and federal guidelines, billing and coding rules, and Molina policies.

Other current Molina Healthcare Review Clinician positions are also advertised as hourly.

Accordingly, Migliaccio & Rathod is investigating whether Molina’s productivity and review requirements may cause some hourly nurses to work outside the time for which they are actually paid.

Nurses May Have Been Required To:

  • review medical records and authorization requests;
  • apply MCG, InterQual, Molina, state, or federal criteria;
  • complete prior-authorization or inpatient reviews;
  • meet turnaround-time requirements;
  • handle substantial daily case volumes;
  • document each review across multiple computer systems;
  • respond to Teams messages, emails, or provider communications;
  • complete unfinished charting after their scheduled shift; or
  • begin logging into systems and preparing cases before their paid shift begins.

Molina Healthcare’s current Medical Review Nurse posting expressly describes employees moving among multiple systems and forms while conducting detailed medical-necessity and coding review.

Why Off-the-Clock Work Matters

Hourly employees generally must be compensated for all time they are permitted or required to work, including required work performed before a scheduled shift, after clocking out, or during an unpaid meal period.

Even relatively small amounts of unpaid time can become significant when the practice occurs repeatedly over months or years.

For example, a nurse who regularly spends 20 or 30 unpaid minutes each day completing required documentation may be losing several hours of compensable time every pay period.

Potential Claims May Include:

  • unpaid overtime under the Fair Labor Standards Act;
  • unpaid straight-time wages;
  • off-the-clock work;
  • unpaid meal-period work where applicable;
  • failure to maintain accurate time records; and
  • unpaid wages or statutory damages under applicable state laws.

Signs You May Be Affected:

  • You worked for Molina Healthcare as a Medical Review Nurse, Care Review Clinician, Utilization Review Nurse, Prior Authorization Nurse, or similar employee;
  • you were paid hourly;
  • you regularly had more work than could reasonably be completed during scheduled hours;
  • you logged into systems or prepared cases before clocking in;
  • you completed reviews, charting, or documentation after clocking out;
  • you worked through unpaid lunches to meet case or productivity requirements; or
  • you responded to required emails, Teams messages, or other communications outside paid working time.
