Migliaccio & Rathod LLP is investigating reports that certain large-scale data centers, including facilities supporting artificial intelligence computing, cloud infrastructure, and cryptocurrency mining operations, may be generating excessive industrial noise that interferes with nearby residential communities.
Across multiple states, residents living near recently expanded data-center facilities report persistent humming, cooling-system noise, ventilation noise, and backup-generator operation occurring around the clock. Some homeowners allege the noise can be heard inside their homes even with windows closed and that it interferes with sleep, outdoor activities, conversations, and general enjoyment of their property.
The investigation is examining whether data-center operators adequately implemented sound-mitigation measures, complied with local noise regulations, and took reasonable steps to reduce off-site impacts on surrounding residential neighborhoods.
Potentially Affected Facilities
Potentially impacted facilities may include:
- artificial intelligence (“AI”) data center;
- cryptocurrency mining facilities;
- cloud-computing data center;
- high-performance computing facilities;
- large-scale server and colocation campuses;
- data-center expansion projects involving cooling towers or diesel generators.
Alleged Common Problems
Residents have reported:
- continuous humming or droning noise occurring day and night;
- excessive cooling-system and ventilation noise;
- diesel backup-generator noise;
- inability to sleep with windows open;
- interference with outdoor activities and conversations;
- headaches, stress, and sleep disruption allegedly associated with constant noise exposure;
- concerns regarding declining property values;
- increased traffic, construction, and industrial activity near residential areas.
Expansion & Infrastructure Concerns
Many of the complaints involve facilities that recently expanded operations or added substantial additional power-generation and cooling infrastructure. Residents allege that these expansions dramatically increased industrial noise levels without adequate sound barriers, insulation, or community mitigation measures.
The investigation is also examining whether some operators failed to utilize available low-noise cooling technologies, acoustic barriers, or other commercially available sound-reduction methods.
Environmental & Consumer Protection Considerations
The investigation is examining whether the alleged conduct may constitute private nuisance, public nuisance, negligence, violations of local noise ordinances, or other state consumer- and property-protection claims.
