Migliaccio and Rathod LLP is investigating the closure a Boar’s Head plant in Virginia, leading to the loss of approximately 500 jobs, for potential violations of the WARN Act.
On Friday, Boar’s Head abruptly announced that it would close a processing plant in Virginia. Employees do not appear to have been given any notice of this decision. With little to no notice of this apparently given to most store employees, many will have to hurry to find new employment opportunities. Our firm is considering all available remedies, including legal action.
Potential Boar’s Head Lawsuit Investigation
Boar’s Head has faced issues recently with a listeria outbreak associated with this facility. The company recently announced that it would be discontinuing its liverwurst line entirely after an investigation concluded that the company was to blame for a recent outbreak. According to CNN, “US Department of Agriculture’s Food Safety Inspection Service reports from the facility have described insects, mold, ‘blood in puddles on the floor’ and a ‘rancid smell in the cooler’ at various points since 2022.”
Clearly these are part of a bigger problem, but the brand seems to have given no indication to employees that it would be closing the facility this week. If you have been recently laid off from Boar’s Head, we would like to hear your story.
Boar’s Head and The Warn Act
The Worker Adjustment and Retraining Notification (WARN) Act is a federal law passed in 1988 that requires employers with 100 or more full time employees to provide at least 60 days of notice for planned mass layoffs. While there are exceptions, generally speaking, if an entire job site or plant is closed, this notice must be provided so that employees can begin seeking alternative employment. Similarly, notice must be given when 50 or more employees are to be laid off at one location.
