Migliaccio & Rathod LLP is currently investigating the Broward Health hospital system for failing to protect sensitive patient and staff information in a data breach in October of 2021. The data breach occurred when an intruder gained entry to the network through the office of a third-party medical provider that was authorized to access its systems. The data breach has impacted upwards of 1.3 million individuals whose information was stored by one of the ten largest public health systems in the United States. While there is no evidence yet of information misuse, it is likely only a matter of time. Personal and medical information was exfiltrated, including name, date of birth, address, phone number, email address, driver’s license number, Social Security number, bank account information, medical history, condition, treatment, and diagnosis.
Cybercriminals often use information extracted from data breaches to commit identity theft. In past data breaches, personal health information has been exploited to create false medical claims and fake prescriptions, or to blackmail victims who do not want sensitive information released. Unlike credit cards and bank account information, which can be changed and recovered quickly, medical history cannot be changed and becomes public knowledge once disclosed.
