Mid South Waffles allegedly pays its servers a sub-minimum wage of $1.20 an hour, while also requiring them to perform non-tipped side work, like sweeping and mopping the floors, washing the walls and windows, cleaning the vents, and other non-tip producing tasks. It is further alleged that managers also force servers to report tip amounts that they did not earn, resulting in servers not receiving the $6.05 tip credit as required by the Fair Labor Standards Act, but also leading to servers having to pay taxes on tips that they did not actually earn. These actions are allegedly illegal because they violate state and federal minimum wage laws.
