Migliaccio and Rathod LLP is investigating the nationwide closure of Foxtrot and Dom’s Kitchen and Market locations for potential violations of the WARN Act.
Tuesday morning, Foxtrot and Dom’s Kitchen and Market (Foxtrot and Dom’s) announced that it would be closing all locations. Employees do not appear to have been given any notice of this decision, and many were visibly alarmed to receive this news alongside customers. Employees could be seen putting up signs announcing the closure in store windows Tuesday morning. With little to no notice of this apparently given to most store employees, many will have to hurry to find new employment opportunities.
About Foxtrot and Dom’s
Foxtrot and Dom’s was, until recently, two separate companies. The two companies announced a merger just a few short months ago in November of last year. Foxtrot was a series of upscale convenience stores while Dom’s operated high-end grocery stores. The two companies merged, being folded under the parent company Outfox Hospitality.
The company had a total of 35 locations across Texas, Chicago, and Washington, D.C. As of this morning, all operations will be ceasing, including food delivery orders. The company announced that, despite much planning and strategizing, it was not possible to save the brand.
The Warn Act
The Worker Adjustment and Retraining Notification (WARN) Act is a federal law passed in 1988 that requires employers with 100 or more full time employees to provide at least 60 days of notice for planned mass layoffs. While there are exceptions, generally speaking, if an entire job site or plant is closed, this notice must be provided so that employees can begin seeking alternative employment. Similarly, notice must be given when 50 or more employees are to be laid off at one location.
