Migliaccio & Rathod LLP is currently investigating the New York-based ATC Healthcare (“ATC”), which recently notified individuals that their highly sensitive personally identifiable and protected health information was accessed by an unauthorized third-party between February 9, 2021 and December 22, 2021. The impacted information includes the following: names, Social Security numbers, driver’s licenses, financial account information, usernames and passwords, passport numbers, biometric data, medical information, health insurance information, electronic/digital signatures, and employer-assigned identification numbers.
ATC only recently began notifying victims of the data breach. Due to this lapse in time between the data breach and the notice to affected individuals and the prolonged access the unauthorized cybercriminal(s) had to the impacted information, hackers may have already been able to sell the data and/or otherwise benefit from the fraudulent misuse of such information. Some individuals affected by the data breach may have already noticed (or may soon notice) one or more of the following types of fraudulent activity related to their personal and health information: unauthorized credit card inquiries and/or charges, requests for loans or benefits in a patient’s name without their consent, fake medical procedures ordered, and/or disrupted use of the institution’s website.
